BESTIMATE TERMS AND CONDITIONS Last Updated: October 30, 2025 1. INTRODUCTION AND ACCEPTANCE These Terms and Conditions ("Terms") govern your access to and use of the Bestimate platform ("Platform"), a service marketplace operated by Bestimate Solutions L.L.C-FZ, a company incorporated in the Meydan Free Zone, Dubai, United Arab Emirates ("Company," "we," "us," or "our"). By accessing or using the Platform—including registering as a Customer or Professional—you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform. 2. DEFINITIONS Customer: A user who posts a request for services on the Platform. Professional or Pro: An independent service provider registered on the Platform. Lead: A service request submitted by a Customer and shown to selected Professionals. Credit: Virtual points or currency that Professionals use to submit Estimates for Leads. Services: The work or tasks offered by Professionals to Customers through the Platform. 3. PLATFORM ROLE AND DISCLAIMERS 3.1 Intermediary Role Bestimate is a technology platform that facilitates connections between Customers and independent Professionals. We do not provide any Services ourselves and are not a party to any contract or agreement made between a Customer and a Professional. 3.2 Independent Contractor Status Professionals are independent contractors. They are not employees, agents, joint venturers, or representatives of Bestimate. We do not direct or control how Professionals perform their work, supply materials, or determine the outcome of Services. 3.3 No Control or Guarantees Customers are solely responsible for selecting a Professional and entering into any agreement with them. Except as described in Section 3.4, we do not and will not: • Guarantee the quality, suitability, legality, or timeliness of any Services • Independently vet, test, or accredit Professionals' skills or workmanship • Guarantee the accuracy, currency, or validity of any licenses, insurance, or credentials provided by a Professional (although Bestimate may conduct a basic visual review of documents such as ID cards or trade licenses for consistency and may grant informational badges accordingly) • Oversee, mediate, or resolve payment arrangements between Customers and Professionals • Act as an insurer or offer warranties for any Services or transactions • Provide any guarantee that the Services will meet your expectations or requirements • Verify or guarantee the accuracy, authenticity, or completeness of any content uploaded by Professionals, including portfolios, project photos, or descriptions of past work By using the Platform, you acknowledge that any contracting for Services is solely between you and the other user (Customer or Professional) and that Bestimate has no control over, and no responsibility for, the actions or omissions of any Customer or Professional. 3.4 Verification Badges and Document Checks From time to time, the Platform may display badges such as "Identification Verified," "Credentials Verified," or similar labels on a Professional's profile. Badges are optional and require document submission. Registration on the Platform does not require document submission, but eligibility to receive a verification badge does. (a) What We Check Where a badge appears, it means that Bestimate reviewed copies of one or more documents submitted by the Professional—such as Emirates ID, UAE trade license, or qualifications/certificates—for basic consistency only, including: • Name match • Document type verification • Unexpired date (where shown) We may also review a limited, representative portfolio of past work submitted by the Professional. (b) What We Do Not Do A badge does not mean that Bestimate: • Verified the document's authenticity with the issuing authority • Conducted an independent audit, site visit, skills test, or background check • Guarantees the ongoing validity of any license, insurance, or credential (which may lapse, be revoked, or change after our review) • Endorses the Professional's quality of work, safety practices, or legal compliance (b-1) Professional's Responsibility for Documents By submitting any identification, trade license, insurance, or qualifications/certificates, the Professional represents and warrants that such documents are: • Genuine, accurate, and unaltered • Lawfully issued to them (or their business) • Authorized for Bestimate's review and storage for verification purposes The Professional must promptly notify Bestimate if any submitted document expires, is revoked, or materially changes. Uploading forged or altered documents is strictly prohibited and may result in badge removal, account suspension or termination, and referral to authorities where appropriate. (c) No Warranty; Your Due Diligence Badges are informational only and not a warranty, endorsement, or guarantee. You remain responsible for your own due diligence, including independently confirming any license, insurance coverage, or qualifications you consider material to your job. (d) Scope and Timing Our review is based on materials provided by the Professional at the time of submission and on information available to us then. Bestimate is under no obligation to re-verify documents on any schedule and may grant, deny, suspend, or revoke badges at its discretion. (e) Misuse or Inaccuracies If we believe a badge was obtained or displayed in error or through misrepresentation, we may remove the badge and take appropriate action, including account restrictions. 4. ELIGIBILITY AND REGISTRATION 4.1 Eligibility Requirements The Platform may only be used by individuals who are: • At least 18 years old • Legally capable of entering into binding contracts under applicable UAE law The Platform is intended for service transactions performed within the UAE. 4.2 Customer Registration To register and sign in, you must provide a valid mobile phone number. We will verify your number and authenticate you using a one-time passcode (OTP) sent via SMS or WhatsApp (passwordless login; no separate username/password required). You agree to: • Provide truthful information • Keep your number up to date • Not share OTP codes with anyone • Notify us promptly of any unauthorized access Standard messaging rates may apply. We may use a trusted third-party provider to deliver SMS/OTP messages. 4.3 Professional Registration To register as a Professional, you must: • Sign up with a unique email address and mobile phone number • Provide accurate business and contact information, including your business (or trade) name and the name of a company representative • Select the service categories and geographic areas in which you offer Services • Agree to these Terms and our Privacy Policy Professional Representations and Warranties By registering as a Professional, you represent and warrant that: • You hold any required UAE trade license or permit for the services you intend to offer • You are authorized to work and operate a business in the UAE Document Submission for Verification We may request copies of your trade license, Emirates ID, and any relevant insurance certificates for verification purposes. Providing these documents is optional and solely for Bestimate's verification purposes; however, submitting acceptable documents is required to be eligible for a verification badge under Section 3.4. If you choose to submit verification documents, you represent and warrant that they are genuine, accurate, unaltered, and lawfully issued to you (or your business), and you authorize Bestimate to review and store copies for verification. Important: Regardless of whether you submit such documents or are marked as verified on our Platform, you remain solely responsible for complying with all legal requirements for offering your Services. 4.4 Ineligible Professionals You may not register or use the Platform as a Professional if: • You do not hold a valid UAE business license or any legally required permit for the Services you intend to provide • You only hold a freelancer permit or visa in an industry unrelated to the services you are offering (for example, a freelance permit for journalism or IT cannot be used to offer home repair services on the Platform) • You are on a tourist visa or otherwise not authorized to work or perform services in the UAE If we determine that you fall into any of the above categories, we reserve the right to suspend or terminate your Professional account immediately. 5. ACCOUNTS AND ACCESS Account Limitations • Each individual or business entity is permitted to maintain only one Customer account and one Professional account • You may not share your account with others • You may not register an account on behalf of someone else without authorization • A user who has registered as a Professional may not create or maintain a Customer account using the same mobile phone number (and vice versa) • Each account type must be associated with a unique and verified phone number Account Security You are responsible for maintaining the confidentiality and security of your login credentials. Any activity conducted through your account will be assumed to be authorized by you. Notify us immediately at support@bestimate.ae if you suspect any unauthorized use of your account. Account Suspension and Termination We reserve the right to suspend or terminate your account at any time if, in our judgment, you have violated these Terms or engaged in improper or fraudulent use of the Platform. If your account is terminated by us due to a violation of these Terms or other policies, you may be barred from re-registering a new account on the Platform for at least 12 months, or indefinitely if we determine the violation was severe. 6. USER CONTENT AND CONDUCT 6.1 Content Rights The Platform may allow users to create profiles, post service requests, send messages, upload images, and publish reviews or other content ("User Content"). You retain ownership of your User Content. However, by submitting or posting User Content on the Platform, you grant Bestimate a non-exclusive, worldwide, royalty-free, perpetual and, to the extent permitted by law, irrevocable, transferable, and sublicensable license to: • Use, reproduce, adapt, modify, and translate your content • Publish, display, and distribute your content • Create derivative works from your content in any media This license is subject to any non-waivable rights you may have under applicable law (such as deletion or correction rights). This license is solely for the purpose of operating, marketing, and improving the Platform. You also agree that Bestimate may use your content (such as reviews or project photos) for promotional purposes. You represent and warrant that you have all necessary rights and permissions to grant this license for any content you provide. 6.2 Content Standards You are responsible for any content you post and any communications you have on the Platform. You agree that your User Content and your use of the Platform will not: 6.2.1 Misrepresentation and Portfolio Authenticity • Present false, misleading, or defamatory information, or misrepresent your identity, qualifications, or affiliation • Display a portfolio that is not your own work or that you are not authorized to show. Portfolio items must depict work you (or your business) actually performed • Use illustrative stock or AI-generated images without clearly labeling them. Never present such images as completed jobs Evidence of Authenticity: Bestimate reserves the right to request evidence that portfolio items or completed works displayed on the Platform are genuine, such as: • Proof of project completion • Client consent • Correspondence showing that the work was actually performed Uploading misleading, copied, or AI-generated work without clear disclosure may result in removal of the content or account suspension. Professional Responsibility: Professionals are solely responsible for the truthfulness and authenticity of all information they upload, including descriptions, photos, and portfolios. Bestimate does not independently verify or guarantee the accuracy of such content. 6.2.2 Rights and Permissions • Do not infringe or violate intellectual property, privacy, publicity (likeness/image), or any other rights of third parties • Do not include faces, names, addresses, license plates, or other personal data without consent • Obtain model/trademark/location releases where required • You represent and warrant that you own the content or have all necessary permissions and consents (including any required releases) so that Bestimate may use it under these Terms 6.2.3 Prohibited, Harmful, or Objectionable Content Do not post content that: • Contains hate speech, harassment, threats, or discrimination (based on race, religion, gender, nationality, disability, or similar characteristics) • Is obscene, sexually explicit, exploitative, or otherwise objectionable • Promotes illegal or unsafe activities, weapons, or dangerous conduct 6.2.4 Spam, Fraud, or Platform Abuse Do not: • Include unsolicited advertising, link farming, bot-generated submissions, deceptive pricing/claims, or fraudulent information • Upload malware or harmful code • Attempt to scrape, probe, or gain unauthorized access to any systems • Disrupt the Platform (e.g., DDoS attacks, brute force attempts) 6.2.5 Legal Compliance Your content must not violate any applicable laws or regulations of the United Arab Emirates, including: • Consumer protection laws • Advertising regulations • Data protection laws • Community guidelines Or any other laws that apply to you. Your Responsibility You are solely responsible for your User Content. If your content infringes someone's rights (such as privacy or publicity rights in photos or videos), you—not Bestimate—are responsible for any resulting claims or liabilities. 7. REVIEWS AND RATINGS Customers may leave reviews and star ratings ("Reviews") about their experience with a Professional. Reviews are intended to provide open and honest feedback. By using the Platform, you acknowledge and agree that: Review Guidelines • Reviews reflect the opinions of individual Customers and do not reflect the opinion of Bestimate • We do not verify the truth or accuracy of reviews • You will not attempt to manipulate the ratings or Reviews system, including by: o Posting false Reviews o Offering incentives for positive Reviews o Coordinating with others to boost or lower ratings Professional Response Professionals cannot publicly reply to Reviews at this time. If you believe a Review violates these Terms or our content guidelines, you may submit a Hide Request for moderation. Verification of Actual Work If Bestimate reasonably believes that a Review does not relate to a genuine service transaction (for example, when there is no in-app discussion, scheduling, or job evidence between the parties), Bestimate may request supporting information or proof from either the Customer or the Professional before retaining the Review. Fake or Manipulated Reviews Reviews found to be fabricated, exchanged, or unsupported by any actual service activity may be removed and may lead to account action. Burden of Proof Where a dispute arises over a Review's authenticity, Bestimate may request relevant screenshots, messages, or photos to assess whether a legitimate service interaction occurred. Review Moderation Bestimate may remove or edit Reviews that: • Violate these Terms or our policies • Are fraudulent or not related to an actual service experience However, we do not remove Reviews simply because they are negative. Prohibited Behavior Harassment, retaliation, or attempts to coerce the removal of a Review are strictly prohibited. 8. SERVICE REQUESTS AND ESTIMATES Posting Requests Customers can post service requests by: • Selecting a service category • Providing details about the needed service (by answering Platform-provided questions or writing a description) • Specifying their location (communities) Once submitted, a service request becomes visible to Professionals who provide the relevant service in the selected category and location. Professional Responses (Estimates) Professionals may use their Credits to submit Estimates in response to a service request. An Estimate typically includes: • Estimated price for the job • Anticipated timeline • Any other relevant details or terms proposed by the Professional Communication After a Professional submits an Estimate, the Customer may: • Review the Estimate • Initiate a chat with that Professional (or multiple selected Professionals) through the Platform to discuss details further All such communications should remain on the Platform until a firm agreement is reached. Time-Sensitive Requests Service requests and Estimates may be time-sensitive. For example: • A Customer's request might automatically close after a certain period • A Customer may receive a limited number of Estimates • Customers may hire a Professional on a first-come, first-served, or best-fit basis Professionals are encouraged to respond promptly. Bestimate does not guarantee that any Professional will be hired or that any Customer will receive a minimum number of Estimates. No Guarantee of Hire (Credits) Spending Credits to send an Estimate only transmits your Estimate to the Customer. It does not guarantee any contact, response, or hire. Credits are deducted when you send an Estimate and are not returned except as expressly provided in the Refund Policy (Section 10). 9. CREDITS AND PAYMENTS Credit Requirements Professionals must use Credits to send Estimates to Customers. Each service category may require a different amount of Credits per Lead, depending on factors such as: • Category type • Location • Demand level • Estimated job size The required Credit amount will be clearly displayed before you send an Estimate. Once you confirm "Send," the corresponding Credits are deducted immediately to deliver your Estimate to the Customer. Credits used are non-refundable unless expressly permitted under our Refund Policy (Section 10). Purchasing Credits Credits can be purchased in the app or on the website using payment methods we support (such as credit/debit card or in-app purchase). • Prices may change at any time • Unless stated otherwise, prices are shown in AED and may include applicable taxes (such as UAE VAT) • All purchases of Credits are final and non-refundable, except as expressly provided in Section 10 Credits Have No Cash Value Credits are a digital product for use solely within the Platform. They are: • Not redeemable for cash • Not transferable between users (except as may be allowed by a specific promotion or at our discretion) • Not personal property and have no value outside of the Platform Credit Expiration • Paid Credits do not expire while your account remains active and in good standing • Promotional/bonus Credits may carry an expiration date or other conditions, which will be shown at issuance or in the applicable promotion terms Third-Party Purchase Platforms If you purchase Credits through a mobile app store (such as Apple App Store or Google Play) or a third-party payment processor, the purchase may also be subject to the terms and conditions of those platforms. In-app purchases of Credits will be billed by the app store provider, and any billing disputes should be directed to that provider as appropriate. Service Payments Between Users Bestimate is not a party to any payments for Services performed by Professionals. The amount, method, and timing of payment for a job are set solely by the Customer and the Professional, and payment is executed directly between them. We do not act as: • An escrow service • A payment processor • An insurer • A guarantor of any payment for work Any payment disputes or service-quality issues must be resolved between the Customer and the Professional (without prejudice to any rights you may have under applicable law). 10. REFUND POLICY (CREDITS) Credits are units used to pay Lead fees on the Platform and are not cash. Credit purchases are generally non-refundable and are not redeemable for cash. However, we may, at our discretion, grant credit-back adjustments to your Credits balance in the following limited situations: Eligible Refund Situations Duplicate Lead: You paid Credits for a Lead that turned out to be a duplicate of another recent Lead from the same Customer for the same job posted within 24 hours (for example, the Customer accidentally posted the request twice). Prohibited or Fraudulent Lead: The Lead clearly violates our Terms (such as a request for an illegal service or containing spam) or is clearly fake/abusive (for example, bot/test submissions, accounts later suspended for policy violations). Note: Messaging is available through in-app chat; inability to reach a Customer outside the Platform is not a basis for a refund. Technical Error: A technical error in the Platform caused an improper charge or misdelivery of the Lead (for instance, you were charged Credits for a Lead that was outside your selected service location or category due to a system glitch). Unviewed Lead: The Customer never opened or viewed your Estimate at all within 72 hours after you submitted it. Important: If the Customer opened or viewed your Estimate but did not respond or did not hire you, that is not refundable under this policy. Requesting a Credit-Back To request a credit-back under one of the above situations: • Contact Bestimate customer support (via the app or email to support@bestimate.ae) within 7 days of incurring the Credit charge for that Lead • Provide details and any evidence (if available) to support your claim • We will review your request and inform you whether a credit-back will be granted Decisions on refunds are at Bestimate's sole discretion and are final. No Refund in Other Cases Credits will not be refunded for reasons outside of the conditions listed above. For example, you will not receive a refund of Credits simply because: • The Customer chose not to hire anyone or did not respond to your communications (as long as the Customer viewed your Estimate) • The Customer's budget or job details were not as you expected (unless the Customer had materially misrepresented the request in violation of our Terms) • You and the Customer could not come to an agreement on terms (a failed negotiation) • You are dissatisfied with the outcome of the job or any service issues (those must be resolved between you and the Customer directly) 11. PROHIBITED CONDUCT When using Bestimate, you agree not to engage in any of the following prohibited activities: Fraud and Misrepresentation Do not: • Create false identities or accounts • Post false Leads or Reviews • Otherwise misrepresent yourself, your Services, your qualifications, or your affiliation with any person or entity • Impersonate any other person or entity • Falsify information in your profile or communications Harassment and Abuse Do not: • Harass, threaten, or abuse other users • Use profanity or slurs • Send unsolicited obscene or inappropriate messages or images • Engage in stalking or unwanted contact Unlawful Content or Use Do not: • Upload, share, or solicit any content that is illegal under UAE law, including but not limited to content that is pornographic, incites violence, or involves the promotion of illegal activities • Use the Platform for any purpose that is illegal or unauthorized The Platform is intended only for lawful transactions for services within the UAE. Intellectual Property Infringement Do not: • Post content or offer Services that infringe on the copyright, trademark, patent, trade secret, or other intellectual property rights of others • Upload content (including text and images) that you do not have the right to use Security Violations Do not: • Attempt to probe, scan, or test the vulnerability of the Platform or any system or network related to the Platform • Breach any security or authentication measures • Distribute viruses, malware, or any other technologies that may harm the Platform or the interests or property of users Data Mining and Automation Do not: • Use any robot, spider, scraper, or other automated means to access the Platform for any purpose without our express written permission • Harvest or collect information about users of the Platform without their consent and our consent Enforcement We reserve the right to investigate and take appropriate legal action against anyone who, in our judgment, violates these rules, including without limitation: • Suspending or terminating their account • Reporting such behavior to law enforcement authorities if necessary 12. DATA PRIVACY We take data privacy seriously. Any personal information you provide to us is handled in accordance with: • Applicable UAE data protection laws (including UAE Federal Decree-Law No. 45/2021 on the Protection of Personal Data) • Our Privacy Policy By using the Platform, you consent to the collection, use, and disclosure of your personal data as described in our Privacy Policy. Professional Obligations If you are a Professional, you agree to use any personal information about Customers (such as names, phone numbers, addresses, or details of service requests) solely for the purpose of fulfilling the Services requested. You must: • Keep such information confidential and secure • Not use it for any other purpose (for example, you may not add the Customer to marketing lists without their explicit consent) 13. INTELLECTUAL PROPERTY Platform Ownership All rights, title, and interest in and to the Platform, including its software, databases, algorithms, user interface, design, trademarks, logos (including "Bestimate"), and all content provided by us (collectively, the "Platform Content"), are the property of Bestimate or its licensors. Platform Content is protected by copyright, trademark, and other intellectual property laws. Prohibited Uses You agree not to: • Reproduce, copy, modify, adapt, distribute, or create derivative works of the Platform Content, except as expressly permitted by us in writing • Reverse engineer, decompile, or attempt to extract the source code of any part of the Platform, except to the extent allowed by law • Use any of our trademarks, service marks, or logos without our prior written consent Permitted Use You may use the Platform and Platform Content only for the intended purposes of the service marketplace and in compliance with these Terms. Any unauthorized use of the Platform or Platform Content is strictly prohibited and may result in termination of your account or legal action. 14. INDEMNITY You agree to indemnify, defend (if we request), and hold harmless Bestimate and its owners, officers, directors, employees, agents, and affiliated companies from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) that arise out of or relate to: • Your use or misuse of the Platform • Your breach of any provision of these Terms or of any applicable law or regulation • If you are a Professional, your provision of Services to any Customer, including any injuries, losses, or damages of any kind arising from your Services • Any User Content you submit or post, including claims that your content infringes or misappropriates the intellectual property or privacy rights of a third party • Your violation of any rights of another user or a third party Defense and Control We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claim. You will not settle any claim requiring indemnification by you without our prior written consent. 15. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law, Bestimate (including its affiliates, officers, directors, employees, and agents) shall not be liable to you or any third party for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of (or inability to use) the Platform or any Services booked through the Platform. This includes, without limitation: • Loss of profits • Loss of business or business opportunities • Loss of data • Loss of goodwill Even if we have been advised of the possibility of such damages. Cap on Liability In addition, and to the fullest extent permitted by law, Bestimate's total aggregate liability to you for all claims arising out of or relating to these Terms or the use of the Platform will not exceed the lesser of: • AED 1,000 (one thousand UAE dirhams), or • The total amount of fees (if any) you paid to Bestimate for the use of the Platform in the 12 months prior to the claim Basis of Limitation The limitations of liability in this Section apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise. Scope of Liability Waiver Without limiting the generality of the foregoing, you specifically agree that Bestimate is not liable for: • Any acts or omissions of the Customers or Professionals you interact with, or any aspect of the Services provided by a Professional (including any personal injuries, property damage, or other damages that may result from a Service) • Any loss or damage that arises from your failure to adhere to any agreements you make with another user (for example, if a Customer fails to pay, or a Professional fails to complete a job) • Any disputes between users of the Platform • Any damage to your computer system or mobile device, or loss of data, that results from downloading or using our app or website (we advise that you use appropriate security software) • Any downtime, suspension, cessation of service, errors, or omissions on the Platform, or any bugs, viruses, or harmful code that may be transmitted through the Platform by any third party Legal Compliance Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under UAE law. However, to the extent that any liability may be limited, you agree that the limitations and exclusions above shall apply. 16. GENERAL TERMS Governing Law and Jurisdiction These Terms and any dispute or claim arising out of or in connection with them or the use of the Platform are governed by the laws of the United Arab Emirates, as applicable in the Emirate of Dubai, and by the regulations of the Meydan Free Zone. You agree that the courts of Dubai, United Arab Emirates shall have exclusive jurisdiction to settle any dispute or claim that is not resolved through informal negotiation. Modifications to Terms We may modify or update these Terms from time to time. If we make material changes, we will notify users by: • Posting the updated Terms on the Platform • Updating the "Last Updated" date at the top of the Terms • In certain cases, sending you an in-app notification Continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform before the new Terms take effect. Severability If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction: • That provision will be enforced to the maximum extent permissible • The remaining provisions of these Terms will remain in full force and effect • The invalid or unenforceable part will be deemed modified to the least extent necessary to make it valid and enforceable No Waiver Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Bestimate. Assignment • Bestimate may assign or transfer its rights and obligations under these Terms (in whole or in part) to an affiliated entity or in connection with a merger, acquisition, reorganization, or sale of assets • You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent • Any attempt by you to do so without consent will be null and void Force Majeure Bestimate will not be liable for any delay or failure in performance of our obligations under these Terms to the extent caused by events or circumstances beyond our reasonable control, including without limitation: • Natural disasters (earthquake, storm, flood) • Fire or explosion • War, terrorism, civil unrest, or riot • Government orders or changes in law, sanctions, or embargoes • Public health emergencies (epidemic or pandemic) and related quarantine/lockdown measures • Labor strikes or other industrial actions • Failures or interruptions of utilities, internet, or telecommunications • Failures or outages of cloud/hosting/CDN, DNS, or payment networks • Large-scale cyberattacks (including DDoS) Force Majeure Process: • The affected party will promptly notify the other party • The affected party will use commercially reasonable efforts to mitigate the impact • The affected party will resume performance as soon as practicable • If a Force Majeure Event continues for more than 30 days, either party may terminate the affected obligations upon written notice For clarity, Force Majeure does not relieve you of the obligation to pay any fees that became due prior to the Force Majeure Event. Entire Agreement These Terms, together with any other policies or agreements expressly incorporated by reference (such as our Privacy Policy and any applicable guidelines on the Platform), constitute the entire agreement between you and Bestimate regarding your use of the Platform. They supersede all prior or contemporaneous understandings and agreements, whether written or oral, on the subject matter. No oral or written statement by any Bestimate employee or agent, or by any user, will vary or alter the terms of this Agreement. 17.
